Terms & Conditions
Intro
Barclay Heritage Ltd trades in used motor vehicles. All vehicles are available for inspection and test drive prior to purchase. By making a deposit or making full payment, you agree to the terms set out below.
1. Definitions

“Seller” means Barclay Heritage Ltd.

“Buyer” means the individual or business purchasing the Vehicle.

“Vehicle” means the motor vehicle identified on the invoice or deposit agreement.
2. Vehicle Description & Condition
-
We take care to describe vehicles accurately. The Buyer is encouraged to inspect the Vehicle and review the history file prior to purchase.
-
Used vehicles will show age-related wear consistent with mileage and age.
-
Mileage is recorded in good faith and supported by MOT history/service records, but cannot be guaranteed unless expressly stated in writing.

Unless specifically stated otherwise, all vehicles are supplied with a valid MOT certificate.

Vehicles are supplied with the key(s), manuals, and accessories present at the time of sale, unless stated otherwise.

The Vehicle is sold as a used motor vehicle. While roadworthy at the time of sale (unless otherwise stated), Barclay Heritage Ltd does not guarantee the Vehicle will remain roadworthy indefinitely. It is the Buyer’s responsibility to ensure the Vehicle remains maintained, serviced, and safe for road use.

Descriptions, photographs, and specifications are provided in good faith for identification and marketing purposes. Minor differences in specification, colour, or trim level may occur. No liability is accepted for such variations.
3. Viewings & Test Drives

Viewings are normally by appointment at our workshop in Thame.
-
By prior arrangement, we may agree to bring the Vehicle to the Buyer for viewing or test drive at a mutually convenient location.
-
A valid UK driving licence must be presented before any test drive.
-
Test drives are accompanied and provided at our discretion. We may refuse a test drive if documentation is not presented, if insurance conditions are not met, or if circumstances are unsuitable.

Any costs associated with bringing the Vehicle to the Buyer will be the Buyer’s responsibility and must be agreed in advance.

Where the Vehicle is taken to the Buyer for the purpose of a viewing or test drive, this shall not constitute “delivery” under these Terms & Conditions. Delivery only occurs once a sale has been completed and is confirmed in writing under Section 6.
4. Deposits & Holding

A standard holding deposit of £100 secures the Vehicle for up to 72 hours, during which it will not be sold to another party.

Unless otherwise agreed in writing, deposits are refundable after the agreed viewing appointment if the Buyer decides not to proceed, provided they attend as arranged.

If the Buyer fails to attend the agreed viewing without prior notice, a £35 retention fee will be applied and the balance of the deposit refunded.
-
If the Buyer confirms purchase, the deposit will be deducted from the final sale price.
-
The deposit amount will be increased to £200 for vehicles over £5000.
-
The specific terms of any deposit, including the Vehicle details, reservation period, and payment method, will be confirmed in writing in a separate Holding Deposit Agreement, which forms part of these Terms & Conditions.

Special Deposit Terms
From time to time, special deposit terms may be agreed to reflect the circumstances of a particular sale (for example, remote purchase, demonstration appointment, or vehicle preparation). Any such variations will be clearly stated on the Holding Deposit Agreement, which takes precedence over the general deposit terms in this document.

Where a demonstration or off-site viewing is arranged at the Buyer’s request, any deposit paid for that purpose is non-refundable if the demonstration does not result in a sale, unless otherwise agreed in writing.
5. Pricing & Payment

All prices are in GBP. Any taxes or fees will be stated on the invoice.

Balance is payable by bank transfer or cleared funds before collection or delivery.
-
Any part-exchange must be accurately described; valuation may be adjusted on inspection.
-
Barclay Heritage Ltd does not apply hidden charges or admin fees. The price agreed is the total price payable, other than optional delivery charges or agreed extras.
6. Collection, Risk & Delivery
-
Risk passes to the Buyer upon collection or agreed delivery.
-
Ownership (legal title) of the Vehicle will not pass to the Buyer until Barclay Heritage Ltd has received full cleared payment.
-
It is the Buyer’s responsibility to ensure the Vehicle is insured and taxed from the time of collection or delivery.

At the point of handover, the Buyer will normally receive:

A signed copy of the Sales Agreement/Invoice,
-
The current MOT certificate,
-
The Vehicle’s service history file (where available),
-
The V5C logbook or green new keeper slip (V5C/2), with Barclay Heritage Ltd notifying DVLA of the keeper change,
-
Any spare keys, manuals, or warranty documents supplied with the Vehicle.

The Buyer (or their representative) must inspect the Vehicle upon delivery. Acceptance of delivery constitutes acknowledgment that the Vehicle matches its description and condition at the point of sale.

Delivery

Delivery may be arranged at the Buyer’s request, either by personal handover or by trailer, at our discretion.
-
Local delivery within 50 miles may be arranged upon payment of a 20% deposit, with the balance payable by cleared bank transfer before handover of the Vehicle.
-
For remote purchases (where the Vehicle is not inspected in person prior to purchase), a payment of 75% of the purchase price must be received in cleared funds prior to dispatch, with the remaining 25% payable by cleared bank transfer on delivery before handover of the Vehicle.

Delivery charges (if any) are non-refundable.
-
Risk transfers to the Buyer once the Vehicle has been delivered.
7. Warranty & Aftercare

Unless a separate written warranty is provided, vehicles are sold as used motor vehicles without any additional warranty, save for any obligations required by law.

Any optional warranty will be documented separately.
-
Barclay Heritage Ltd recommends that vehicles are maintained in line with manufacturer schedules, and we are happy to provide ongoing servicing, MOT preparation, and maintenance at competitive rates.
8. Returns, Faults & Consumer Rights

Barclay Heritage Ltd aims to be as transparent as possible in the description and presentation of every vehicle. We will do our best to answer any questions, but buyers are encouraged to carry out their own research, inspections, and test drives prior to purchase.

All vehicles are used and may display age-related wear and tear, including cosmetic imperfections and mechanical wear consistent with mileage, age, and price. Such matters are expected and do not constitute a defect under these Terms.

Any defects disclosed in the advert, MOT advisories, or pointed out during the viewing form part of the sale and cannot be raised as grounds for return.

Remedies will be provided where required by law.

No remedy is available for wear-and-tear items (e.g. tyres, brakes, clutches, exhausts, batteries, fluids), cosmetic issues, damage or faults arising after collection, issues consistent with age and mileage, or trade/business-to-business sales (all trade sales are strictly sold as seen with no warranty implied).
9. Distance Sales & Returns

All vehicles are available for viewing and inspection prior to purchase. Sales are final once payment has been received and the Vehicle collected or delivered following such inspection.

Where a purchase is completed entirely remotely, without the Buyer inspecting the Vehicle beforehand, additional statutory rights may apply.

Any returns under such rights require the Vehicle must be returned in materially the same condition, with delivery charges non-refundable and any mileage or damage deductible from any refund.
10. HPI / Title
-
We conduct provenance checks (e.g. HPI/Experian), however we encourage customers to conduct their own checks also. Copies available on request.
-
Title will be clear of finance at the point of sale.
11. ULEZ, Congestion & Emission Zone Charges
-
Barclay Heritage Ltd accepts no responsibility or liability for any Ultra Low Emission Zone (ULEZ), Congestion Charge, Clean Air Zone, or similar regional emissions-related charges, penalties, or restrictions that may apply to the Vehicle.
12. Data Protection

We process personal data in accordance with UK GDPR for identification, invoicing, insurance and record-keeping.

We do not sell personal data to third parties.
13. Governing Law
-
These terms are governed by the laws of England and Wales.
-
The courts of England and Wales have exclusive jurisdiction.

These Terms & Conditions constitute the entire agreement between the Seller and Buyer and supersede any prior communications or representations not expressly included herein.
